Terms of Service

These Terms are an agreement between you and 3DMOCKUPS LLC (“3DMockups,” “we,” or “us”) governing our website, iOS and Android apps, editor, community, marketplace, and related services (the “Services”). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility and authority
You must be at least 13 years old, or the higher minimum age required where you live. If you are under 18, you may use general features only with permission from a parent or legal guardian. You must be at least 18 and legally able to contract to sell products, receive payouts, or participate in Creator Rewards.
If you use the Services for a company or another person, you represent that you have authority to bind them. You may not use the Services if law prohibits you from doing so.
2. Accounts and security
Provide accurate information, keep your credentials secure, and promptly update your details. You are responsible for activity under your account unless caused by our breach of a duty imposed by law. Tell us promptly at support@3dmockups.app if you suspect unauthorized access. You may not sell, transfer, or share an account in a way that defeats verification, sanctions, purchase, or payout controls.
3. Subscriptions, offers, and payments
The purchase screen shows the price, currency, billing period, included features, trial or introductory period (if any), and renewal terms that apply to your purchase. Different users may lawfully receive different promotions or test offers. The specific offer and price displayed to you immediately before you confirm the purchase controls your order.
Recurring subscriptions renew automatically for the period shown unless canceled before the renewal date. Taxes may be added where required. We may change a future renewal price only with the notice and consent required by your billing provider and applicable law.
Charges made through Stripe are governed by the checkout confirmation and can be managed through the billing portal in account settings. Purchases made through Apple's App Store or Google Play are billed and refunded by that store under its rules.
Virtual credits or coins are a limited, non-transferable license for eligible in-product features. They are not money, cannot be sold or transferred, and are not redeemable for cash except where law requires otherwise.
4. Cancellation and refunds for subscriptions
- Web/Stripe: use Settings → Manage Billing and cancel in the Stripe customer portal.
- Apple: cancel in your Apple ID subscription settings. We cannot cancel an App Store charge on Apple's behalf.
- Google Play: cancel in Google Play under Payments & subscriptions → Subscriptions.
Unless the purchase screen, billing provider, or applicable law says otherwise, cancellation stops the next renewal and access continues through the already-paid period. Deleting the app or your 3DMockups account does not automatically cancel an Apple or Google subscription. Refund eligibility is determined by the store that billed you, our displayed offer, and mandatory consumer law.
5. Marketplace and physical products
Marketplace purchases and sales are additionally governed by our Marketplace & Seller Terms and Shipping, Returns & Refund Policy. Those documents explain seller responsibilities, production and fulfillment, fees and payouts, chargebacks, customized goods, cancellation limits, and remedies for damaged, defective, incorrect, or missing orders.
Order totals and available destinations are shown before payment. Delivery estimates are estimates, not guarantees. Taxes, customs charges, or import duties may apply based on the destination and applicable law and are not included unless the checkout expressly says so.
6. Your content and licenses
You retain ownership of content you create. You give us a non-exclusive, worldwide, royalty-free license to host, reproduce, adapt for technical formatting, display, and distribute content only as needed to operate, secure, improve, and promote the feature in which you intentionally shared it. For a public post or listing, this includes public display and previews. Removing content ends future use under this general license within a reasonable operational period, except for lawful records, cached copies, completed orders, and uses already shared by others.
Marketplace sellers grant the additional production and sales permissions in the Marketplace Terms. Creator Rewards submissions are used in advertising only under the separately accepted Creator Content License.
You represent that you own or have all permissions necessary for content you upload, publish, manufacture, sell, or ask us to process, including rights to names, likenesses, trademarks, fonts, music, and third-party artwork.
7. AI features
AI features may send your prompt and selected content to third-party model providers. Do not submit confidential, regulated, biometric, or third-party personal information unless you are authorized and the feature is appropriate for it. Outputs can be inaccurate, incomplete, similar to other outputs, or ineligible for intellectual-property protection. Review outputs before relying on or publishing them. We do not guarantee accuracy, uniqueness, non-infringement, or fitness for a particular purpose.
You may not use AI or other Services to create or distribute fraud, impersonation, exploitation, unlawful sexual content, nonconsensual intimate imagery, harmful deepfakes, or content that violates another person's rights.
8. Community rules and prohibited conduct
You may not use the Services to:
- violate law, intellectual-property, privacy, publicity, consumer, or contractual rights;
- post sexual exploitation material, nonconsensual intimate imagery, threats, targeted harassment, hate, or instructions for serious harm;
- impersonate others, misrepresent endorsements, manipulate reviews or engagement, or commit fraud;
- upload malware, probe security, bypass access or payment controls, scrape personal data, or overload the Services;
- use bots or automation except through an interface or permission we expressly provide; or
- publish personal or confidential information without authorization.
We may remove or restrict content, listings, features, or accounts where reasonably needed to enforce these Terms, protect users, comply with law, prevent losses, or investigate a credible complaint. We may preserve relevant evidence where legally permitted.
9. Reporting, copyright, and intimate-image removal
Use in-app reporting or email support for abuse and safety concerns. A victim or authorized representative can use our Safety Takedown Request for nonconsensual intimate images. Valid requests are handled under applicable law, including removal of known identical copies within the legally required period.
Copyright notices and counter-notices must follow our Copyright & DMCA Policy. We maintain a policy for terminating repeat infringers in appropriate circumstances.
10. Our software and intellectual property
The Services, software, 3D models, templates, branding, and materials we provide are owned by us or our licensors. Subject to these Terms, we give you a limited, revocable, non-exclusive, non-transferable right to use the Services for their intended purpose. No ownership transfers to you, and you may not reverse engineer or redistribute protected components except where law expressly permits it.
11. Availability, warranties, and consumer rights
We may maintain, change, or discontinue features, but will honor mandatory notice, refund, and access rights. To the fullest extent permitted by law, the Services are provided “as is” and “as available” without implied warranties. We do not promise uninterrupted operation or that every output or user submission is accurate or lawful.
Nothing in these Terms excludes a warranty, remedy, cooling-off right, product guarantee, or other consumer right that cannot legally be excluded where you live.
12. Limitation of liability
To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, punitive, or consequential damages, or lost profits or data, arising from the Services. Our aggregate liability for a claim will not exceed the greater of US $100 or the amount you paid us for the affected Service during the six months before the event.
These limitations do not apply where prohibited, including liability that cannot be limited for fraud, willful misconduct, gross negligence, death or personal injury, mandatory product liability, or violation of non-waivable consumer or privacy rights.
13. Indemnity for commercial and unlawful use
If you use the Services as a seller, creator, or business, you will defend and indemnify 3DMockups from third-party claims arising from your listings, products, advertising, content, violation of law, or breach of rights and warranties you give us. This section does not require a consumer to indemnify us for our own misconduct and applies only to the extent permitted by law.
14. Suspension, termination, and account deletion
You may stop using the Services and request account deletion through Settings or our web deletion page. Account deletion is separate from subscription cancellation and from an order already in production.
We may suspend or terminate access for a material or repeated breach, fraud, security risk, legal requirement, or serious harm. When reasonable, we will provide notice and an opportunity to appeal. Provisions that by their nature must survive—such as payment, completed-order, license, dispute, and liability terms—remain effective.
15. Governing law and mandatory local rights
New York law governs these Terms without regard to conflict-of-law rules. Courts located in New York have jurisdiction, except that consumers may bring claims in any local forum and rely on any governing law that cannot validly be waived. Nothing here prevents either party from using small-claims court or seeking urgent injunctive relief where available.
16. Changes and general terms
We may update these Terms to reflect product, legal, or security changes. We will update the date above and provide additional notice or request renewed acceptance for material changes where required. If a provision is unenforceable, it will be limited to the minimum extent necessary and the rest remains in effect. Failure to enforce a provision is not a waiver.
These Terms, the Privacy Policy, and any feature-specific terms presented to you form the agreement for the Services.
