We reserve the right to modify or update these Terms at any time. When we do, we will revise the "Last Updated" date at the top of this page. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms. 3. Eligibility

5. Subscriptions and Payments

We offer subscription plans for certain premium features and content within the App. By purchasing a subscription, you agree to the following terms:

Subscription Fees: The subscription fee, billing cycle, and applicable taxes will be described at the time of purchase. All fees are payable in advance and are non-refundable except as required by law or stated otherwise in these Terms.

Automatic Renewal: Unless you cancel your subscription, it will automatically renew at the end of each billing cycle at the then-current subscription rate. You authorize us (or our third-party payment processor) to charge your payment method for the applicable subscription fees.

Free Trials: We may offer free trials of certain subscription plans. If we do, we will specify the duration of the free trial. At the end of the free trial, you will be charged for the subscription unless you cancel before the trial ends.

Cancellation: You may cancel your subscription at any time through your account settings or by contacting us at 3dmockupsofficial@gmail.com. Cancellations take effect at the end of the current billing cycle, and you will retain access to the subscription benefits until then.

Refunds: Except where required by law, subscription fees are non-refundable. If you believe you deserve a refund due to extraordinary circumstances, please contact us at the email address above.

6. License and Intellectual Property

License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Services for your personal or internal business purposes.

Ownership: All content, software, and materials used in the provision of the Services (collectively, "Our Content") are owned or licensed by us and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of Our Content without our prior written consent.

User-Generated Content: Any 3D designs, models, or other materials you create or upload to the App ("User Content") remain your property. However, by uploading or sharing User Content, you grant us a non-exclusive, royalty-free license to use, host, store, reproduce, and display such content as needed to operate and improve the Services.

7. User Conduct

By using the Services, you agree not to:

• Upload or share any content that is unlawful, defamatory, hateful, abusive, or infringes upon the intellectual property or privacy rights of others.
• Use the Services for any illegal or unauthorized purpose.
• Interfere with or disrupt the Services, servers, or networks connected to the Services.
• Attempt to gain unauthorized access to any portion of the Services or any other accounts, systems, or networks connected to the Services.

We reserve the right (but are not obligated) to monitor or remove any User Content that violates these Terms or is otherwise objectionable at our sole discretion.

8. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. 3DMOCKUPS LLC MAKES NO WARRANTIES OR REPRESENTATIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 3DMOCKUPS LLC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US (IF ANY) FOR THE USE OF THE SERVICES IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

10. Indemnification

You agree to defend, indemnify, and hold harmless 3DMOCKUPS LLC and its affiliates, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

11. Governing Law and Dispute Resolution

These Terms and your use of the Services are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the state or federal courts located in New York, New York, and you consent to personal jurisdiction in such courts.

12. Termination

We reserve the right, in our sole discretion, to suspend or terminate your account and your access to the Services at any time and for any reason, including but not limited to your breach of these Terms. Upon termination, your right to use the Services will immediately cease. The provisions of these Terms that by their nature should survive termination shall continue to apply, including but not limited to intellectual property rights, indemnity, disclaimers, and limitations of liability.

13. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and 3DMOCKUPS LLC regarding your use of the Services.

Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment: You may not assign or transfer these Terms or your rights or obligations hereunder without our prior written consent. We may assign or transfer these Terms at any time without restriction.
