We reserve the right to modify or update these Terms at any time. When we do, we will revise the "Last Updated" date at the top of this page. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms. If the changes are significant, we may provide a more prominent notice or request your consent where required by law.

3. Eligibility

Age Requirement: You must be at least 13 years of age (or the minimum legal age in your jurisdiction) to use our Services. If you are under 18, you must have your parent or legal guardian's permission to use the Services.

5. Community Features

Our Services include community features that allow you to share content, interact with other users, and participate in our creative community. These features include:

• Posts: Share your 3D designs, mockups, and AI-generated images with the community.
• Likes: Express appreciation for content created by other users.
• Comments: Engage in discussions and provide feedback on posts.
• Profiles: Create a public profile showcasing your work and activity.
• Following: Follow other creators to see their latest content.

By using these features, you agree to abide by our Community Guidelines outlined in Section 7.

6. Subscriptions and Payments

We offer subscription plans for certain premium features and content within the App. By purchasing a subscription, you agree to the following terms:

Subscription Fees: The subscription fee, billing cycle, and applicable taxes will be described at the time of purchase. All fees are payable in advance and are non-refundable except as required by law or stated otherwise in these Terms.

Automatic Renewal: Unless you cancel your subscription, it will automatically renew at the end of each billing cycle at the then-current subscription rate.

Free Trials: We may offer free trials of certain subscription plans. At the end of the free trial, you will be charged for the subscription unless you cancel before the trial ends.

Cancellation: You may cancel your subscription at any time through your account settings or by contacting us at 3dmockupsofficial@gmail.com.

7. Community Guidelines and User Conduct

To maintain a positive and respectful community, you agree to the following guidelines when using our Services:

Prohibited Content

You may NOT post, share, or transmit content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or discriminatory
• Contains nudity, sexually explicit material, or pornography
• Promotes violence, hatred, or discrimination against individuals or groups
• Infringes on intellectual property rights, copyrights, or trademarks of others
• Contains spam, phishing attempts, or malicious links
• Impersonates another person or misrepresents your identity
• Promotes illegal activities, drugs, or dangerous behavior
• Targets or bullies other users
• Contains personal information of others without their consent

Prohibited Behavior

You may NOT:

• Harass, stalk, or intimidate other users
• Create multiple accounts for deceptive purposes
• Use automated systems or bots to interact with the Services
• Manipulate likes, comments, or other engagement metrics
• Attempt to gain unauthorized access to other users' accounts
• Interfere with or disrupt the Services or servers
• Collect user information without consent

Enforcement: We reserve the right to remove any content and suspend or terminate accounts that violate these guidelines, at our sole discretion and without prior notice.

8. User-Generated Content

Ownership: You retain ownership of all content you create and share through the Services ("User Content"), including 3D designs, mockups, images, comments, and other materials.

License Grant: By posting User Content to public areas of the Services (including the community), you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, modify, and distribute your User Content in connection with operating and promoting the Services.

Public Content: Content you share in the community is public by default and may be viewed, liked, commented on, and shared by other users. Consider this before posting.

Responsibility: You are solely responsible for the content you post and must ensure you have all necessary rights to share it.

9. Content Moderation

Reporting: If you encounter content or behavior that violates these Terms, please report it through the in-app reporting feature or by contacting us at 3dmockupsofficial@gmail.com.

Review Process: We review reported content and take appropriate action, which may include removing content, issuing warnings, or suspending accounts.

No Obligation: While we strive to maintain a safe community, we are not obligated to monitor all content and cannot guarantee removal of all violating content.

10. Intellectual Property

Our Content: All content, software, and materials used in the provision of the Services (excluding User Content) are owned or licensed by us and are protected by intellectual property laws.

Respect for IP: You must respect the intellectual property rights of other users and third parties. Do not copy, reproduce, or claim ownership of content created by others.

DMCA: If you believe your copyrighted work has been infringed, please contact us with a detailed notice at 3dmockupsofficial@gmail.com.

11. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. 3DMOCKUPS LLC MAKES NO WARRANTIES OR REPRESENTATIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE ARE NOT RESPONSIBLE FOR USER CONTENT OR THE ACTIONS OF OTHER USERS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 3DMOCKUPS LLC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, OR DATA, ARISING FROM YOUR USE OF THE SERVICES OR INTERACTIONS WITH OTHER USERS. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US (IF ANY) FOR THE USE OF THE SERVICES IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

13. Indemnification

You agree to defend, indemnify, and hold harmless 3DMOCKUPS LLC and its affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses arising out of or related to your use of the Services, your User Content, your interactions with other users, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

By You: You may delete your account at any time through your account settings. Upon deletion, your profile and posts may be removed from the community.

By Us: We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Services will immediately cease.

15. Governing Law and Dispute Resolution

These Terms and your use of the Services are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the state or federal courts located in New York, New York.

16. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and 3DMOCKUPS LLC regarding your use of the Services.

Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary.

No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
