Marketplace & Seller Terms

1. Scope and marketplace roles

These terms supplement the Terms of Service for every physical-product listing, purchase, sale, sample order, Shopify publication, and seller payout. 3DMockups operates the marketplace, processes marketplace checkout through Stripe, coordinates print-on-demand production and shipping, and provides order support. The seller supplies the creative design and listing information. Printful or another named production partner manufactures and ships the physical item.

A listing does not make a seller our employee, agent, franchisee, or partner. Nothing here removes mandatory rights a consumer has against 3DMockups, a seller, or a manufacturer.

2. Buyer purchase terms

  • The product, variant, quantity, shipping charge, currency, and total shown at final checkout form your order.
  • An order is accepted after payment is successfully confirmed and the order passes fraud, availability, address, and content checks.
  • Products are made to order. Colors, print placement, scale, and fabric appearance can vary reasonably from a screen preview.
  • Delivery dates are estimates. Customs, carrier, weather, address, or production delays can affect arrival.
  • Taxes, customs charges, or import duties may apply and are not included unless checkout expressly identifies them as included.

Cancellation, returns, damaged or incorrect products, missing shipments, and refunds are governed by our Shipping, Returns & Refund Policy.

3. Seller eligibility and verification

A seller must be at least 18, use accurate legal and contact information, and complete Stripe Connect identity, sanctions, tax, and bank verification before receiving payouts. You may not sell for another person, evade a suspension, or route proceeds to an account you are not authorized to use. Stripe may independently require documents or restrict a connected account under its own agreement.

4. Listings, designs, and product compliance

Sellers are responsible for accurate titles, descriptions, categories, prices, variants, and previews. You represent that you own or have commercial rights to every design and to any name, logo, trademark, likeness, font, image, or other material it contains. You must keep evidence of those rights and provide it if reasonably requested.

Listings may not be illegal, deceptive, unsafe, infringing, hateful, exploitative, sexually explicit, or targeted at a person without permission. You must promptly cooperate with a safety, intellectual-property, recall, regulator, or consumer complaint. We may reject, pause, or remove a listing where reasonably necessary without affecting legitimate payouts already earned.

5. License to produce and sell

For as long as a listing or related order remains active, the seller grants 3DMockups and its production, commerce, and shipping providers a worldwide, non-exclusive, royalty-free, sublicensable license to reproduce, resize, color-process, mock up, display, manufacture, package, market, sell, and deliver the design solely for the listing, sale, support, and fulfillment. The license continues only as needed to complete existing orders, process returns or disputes, preserve required records, and defend claims after unpublishing.

6. Prices, production cost, and platform fee

Publishing is currently free. For a non-sample marketplace sale, the platform commission is 5% of Seller Margin, not 5% of the full retail price. Seller Margin means the item's retail price minus the applicable base production cost. The seller's estimated earnings and deductions are shown when pricing the listing. Shipping, buyer taxes, refunds, discounts, and size surcharges are handled separately as shown for the order.

Production and variant costs can change. The order record's server-calculated breakdown, based on the valid cost at purchase, controls the payout. We will not apply a new commission rate retroactively to a completed sale. If we change the rate for future sales, we will give notice and request renewed acceptance where required.

7. Payouts, reserves, refunds, and chargebacks

Eligible proceeds are routed through Stripe Connect and paid on the schedule and subject to the availability shown in Stripe. Payout timing is not guaranteed while an order, identity check, fraud review, refund, dispute, legal hold, or negative balance is unresolved.

The seller authorizes 3DMockups and Stripe, to the extent permitted by law, to reverse a transfer, debit or offset future seller earnings, or hold a reasonable reserve for amounts attributable to that seller's order, including refunds, chargebacks, fraud, intellectual- property claims, fulfillment losses caused by seller content, penalties, and payment fees. We will not recover from a seller losses caused solely by 3DMockups' own error or misconduct. We will provide the available reason and transaction record and a way to dispute a mistake.

8. Taxes and records

Sellers are responsible for income, business-registration, and tax obligations arising from their earnings and for accurate tax information requested by Stripe or us. 3DMockups will collect, report, withhold, or remit transaction taxes where it determines the law requires it. Neither a seller nor buyer should assume a tax or duty is included unless checkout says so. Each party should keep the records required in its jurisdiction and obtain professional tax advice for its circumstances.

9. Buyer information and seller advertising tools

A seller may use buyer information received through the marketplace only to support the transaction, comply with law, prevent fraud, or for another purpose clearly disclosed with a valid legal basis. Sellers may not sell buyer data, add a buyer to marketing without the required permission, or use it after it is no longer needed.

A seller who configures a pixel or conversion API is responsible for its lawful use, accurate privacy disclosures, platform terms, consent, and honoring opt-outs. 3DMockups sends optional seller advertising events only when the required consent evidence exists.

10. Shopify channel sales

A merchant who publishes through Shopify remains responsible for its Shopify storefront, buyer-facing descriptions and policies, taxes it must collect, customer communications, and permissions for any data it sends. 3DMockups uses relevant order data to route production, return tracking and support compliance requests. Shopify buyers are not enrolled in our marketing merely because we fulfilled an item.

11. Enforcement, termination, and survival

We may pause listings, onboarding, transfers, or payouts only where reasonably needed for legal compliance, verification, fraud, safety, disputes, a negative balance, or a material breach. When reasonable, we will provide notice and an appeal path. Ending seller status does not cancel accepted orders or payment, refund, license, recordkeeping, indemnity, or dispute obligations that arose earlier.

12. Risk allocation and contact

The warranty, liability, mandatory consumer-rights, governing-law, and dispute provisions in the Terms of Service apply. A seller will defend and indemnify 3DMockups against third-party claims caused by the seller's design, listing, unlawful advertising, breach of these terms, or violation of another person's rights, but not for losses caused solely by 3DMockups.
